Survey Contest Terms & Conditions

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PARTICIPATING IN “KUNTUM SURVEY” CONTEST (“CONTEST”) AS THEY CONTAIN BINDING LEGAL TERMS AND OBLIGATIONS INCLUDING LIMITATIONS OR EXCLUSION OF OUR LIABILITY. BY PARTICIPATING IN THE CONTEST, YOU ARE DEEMED TO UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS IN ITS ENTIRETY. IF YOU DO NOT AGREE TO ANY OF THESE TERMS AND CONDITIONS, YOU MUST NOT PROCEED TO PARTICIPATE IN THE CONTEST. TERMS AND CONDITIONS
  1. The Contest is organised by Star Media Group Berhad (Company No.: 197101000523 [10894-D]) (“Organiser”) and is open to Kuntum subscribers with an active subscription and those who have purchased single copies of Kuntum magazine within the period of 1st January 2020 to 31st July 2020 who are residing in Malaysia, and aged 18 years at the time of entry to the Contest save and except for: –
    • permanent and/or temporary employees of the Organiser and/or its respective subsidiaries and/or its affiliates, and their immediate family members (defined as parents, siblings, children or domestic partners, regardless of where they live) or households of such officers, directors, employees, agents and representatives; and
    • representatives and/or business partners (including advertising, promotion and public relations agencies) of the Organiser and their immediate family members (defined as parents, siblings, children or domestic partners, regardless of where they live) or households of such officers, directors, employees, agents and representatives.
  2. The Contest will commence on 21st July 2020 at 12.00 a.m. and end on 4th August 2020 11.59 p.m. (“Contest Period”):-
  3. There are twenty (20) prizes to be won. The Organizer will award one (1) random prize to every 40th entry from the following pool of prizes:
    • Ten (10) Kuntum T-shirts (random design)
    • Ten (10) Kuntum mini pouches (random design)
  4. To participate in the Contest:
    • Participant must click on the survey link provided in the electronic direct mail (EDM) sent to his/her registered email address and complete the survey; and
    • Participant must provide his/her accurate personal details and submit the survey form to enter the Contest.
  5. Each participant is allowed to submit one entry (1) ONLY. Multiple entries will be disqualified and only the first entry submitted by each participant will be considered as a qualified entry to the Contest.
    • Multiple entries will be vetted based on submitted details including address, email, mobile number and subscription details if any.
  6. Participant who provides irrelevant and/or incomplete submission will be automatically disqualified.
  7. The Organiser shall not be held liable in the event the selected participant cannot be contacted for any reason whatsoever.
  8. Each participant can win ONLY one (1) prize throughout the Contest Period.
  9. Submissions that do not comply with any of these terms and conditions shall be automatically disqualified from this Contest. Organiser is entitled to reclaim the awarded prize(s) in the event that the submission violates any of these terms and conditions.
  10. Upon verification and confirmation from the winners, arrangements will be made to courier the prizes to the winners’ addresses. The Organiser is not liable for delivery failures caused by the winner providing incorrect delivery addresses.
  11. The prizes are subject to availability. The Organiser reserves the absolute discretion to substitute any of the prizes with other products and/or services of similar value, at any time it deems fit and necessary. All prizes are given on an “As Is Where Is” basis and are not exchangeable for cash, credit, other prizes or voucher, whether in part or in full.
  12. By participating in this Contest, the participants acknowledge and agree that the Organiser excludes all warranty and/or liability in connection with the awarded prizes and/or the Contest. Participants shall assume full liability and responsibility in case of any liability, mishap, injury, loss, damage, claim or accident (including death) resulting from their participation in the Contest, redemption and/or usage of the prizes. The Organiser shall not be responsible for any liability, mishap, loss, damage, claim or accident (including death) in any manner whatsoever suffered by the participants as a result of their participation in the Contest and/or the use of the prizes.
  13. All costs, fees, and/or related expenses incurred or to be incurred by the participants in relation to the Contest, and to claim the prizes won, which shall include but not limited to the costs for transportation, postage/courier, personal costs and/or any other costs, are the sole responsibility of the winners and/or the participants, and the winners must abide by all laws and regulations currently in place and the terms and conditions of the party(ies) arranging and/or providing for the prizes and the terms and conditions attached to the prizes, if any.
  14. While the Organiser will use reasonable efforts to include accurate and up to date information in the Contest’s website at https://www.kuntum.com.my, the Organiser makes no warranties or representations as to the accuracy, correctness, reliability or otherwise with respect to such information, and assumes no liability or responsibility for any omissions or errors (including, without limitation, typographical errors and technical errors) in the content.
  15. PERSONAL DATA PROCESSING STATEMENT RELATING TO PARTICIPANT (this “Notice”) IN ACCORDANCE WITH PERSONAL DATA PROTECTION ACT, 2010 (“PDPA”) AND PUBLICITY
    • 15.1 The PDPA governs the processing of the participant’s personal data (“Personal Data”) by the Organiser. This Notice is issued to Participants to inform that this is the basis upon which, the processing of the Personal Data is done by the Organiser.
    • 15.2 Purpose: All information (including Personal Data) submitted by the participants in their participation of the Contest shall belong to the Organiser and the participants irrevocably and unconditionally consent and permit the Organiser to use, publish or feature the Participants’ and/or their pictures (which may include the participant’s name, statements about the Contest or any of its related matter) without further notice or compensation for publicity, advertising or any other related purposes in any manner whatsoever, including but not limited to in any of the Organiser’s publications, websites and/or any promotional materials connected to the Contest.
    • 15.3 Transfer: The participants’ Personal Data will be kept confidential by the Organiser but the participants agree that for the purposes set out in Clause 15.2 above, the Organiser may transfer or disclose such Personal Data to the following parties within or outside of Malaysia:
      • Other partners or any participating partners which owe a duty of confidentiality to the Organiser;
      • The Organiser’s agents or contractors under a duty of confidentiality to the Organiser providing administrative, telecommunications, data processing or other services to the Organiser in relation to the Contest (such as but not limited to professional advisers, customer call centre providers, gift redemption centres or data entry companies);
      • Any affiliates that owe a duty of care to the Organiser;
      • Any law enforcement agency and/or regulatory body for compliance with applicable laws, rules, regulations, codes and/or guidelines and/or any person or entity to whom the Organiser is under a binding obligation to make disclosure under the requirements of any law, rule, regulations, code and/or guideline and/or order of any competent court of law, law enforcement agencies and/or regulatory bodies.
    • 15.4 Access: The participants have the right to request access to and to request correction of their Personal Data. Nothing herein contained shall limit the rights of any participant under the PDPA.

If the participants do not wish to receive the latest information about products, news and events updates, rewards and promotions, special privileges and initiatives from the Organiser and/or its affiliates, partners and advertisers, kindly call 1300-88-7827 or email to customerservice@thestar.com.my.
  16. Participant hereby agrees and acknowledges that he/she shall provide correct and complete personal information, including but not limited to such as name, contact number, email address, and correspondence address, for the purposes of this Contest.
  17. The Organiser reserves the right to amend any of these terms and conditions at any time without prior notice and the amended terms and conditions will be uploaded on https://www.kuntum.com.my/survey-terms/. Participants are encouraged to visit the said site regularly to ensure that they are aware of any amendments made by the Organiser. Participants’ continued participation in the Contest after amendments are posted onto the said site means they agree to be legally bound by these terms as amended.
  18. If this Contest is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Organiser, the Organiser reserves the absolute right, in its sole discretion, to amend the terms and conditions for this Contest, modify the Contest, suspend, terminate or cancel the Contest, as appropriate, without prior notice.
  19. All entry instructions and any other specific details relating to the Contest or the prizes not specified herein shall form part of these Terms and Conditions.
  20. The Organiser’s decisions are final and there shall be no appeal entertained and/or allowed. All participants shall not resort to court proceedings to review the Organiser’s decisions.
